These Terms of Use (“Terms”) govern your use of Pets! (unless expressly stated that separate terms and conditions apply, not these) and contain the information about the Pets! Service (“Service”) set out below. By creating an account in Pets! or using Pets!, you agree to these terms.

 

The Service Pets!Pets!Pets!

 

We agree to provide you with the Pets! Service. Service includes all products, functions, applications, services, user interfaces, customer support, technologies, program code, software, as well as derivatives of the listed items that we provide to fulfill the mission of Pets! help you and your pets become more useful and closer to each other, other people and pets.

 

The Service includes the following components:

 

• Works aimed at providing access to the Service.

• Development of algorithms and functionalities that allow us to develop our Service.

• Storing and transferring data within the System around the world, including outside the country of your residence, which is a necessary and indispensable condition for the provision of the Service.

• Opportunity to learn new things, exchange experiences, share information, advice, their thoughts, experiences with other people.

• Creating an accessible and secure environment.

• We strive to give you the opportunity to strengthen relationships with other people and their pets by sharing experiences and talking about what is important to you. Therefore, we create the Service to understand who and what interests you and your pets and other users and their pets, and use this information to help create or find interesting content, track what other people are sharing, and share with them what can be important for everyone.

• We develop and use the functionality and offer the users of our Service resources to help ensure a useful and safe interaction for everyone in the Service. We use all the information we have (including your information) to keep the Service secure. We may also share information about abuse or harmful content with the police.

• We use data uploaded to the Service, as well as from third party partners, to show you advertisements, offers and other sponsored content that we believe will be relevant to you. At the same time, we try to ensure that such content is no less relevant to you than the rest of the materials that you see in the Service.

• We use the information available in the Service to study the Service and, in cooperation with others, conduct research in order to improve it and improve the well-being of our users, their pets and partners of the Service.

 

Financial conditions for using the Service

 

The use of most of the functions of the Service is free, however, by using the Service, you thereby agree that we can show you advertisements for which companies and organizations pay us (both third-party companies and organizations, as well as internal companies and projects affiliated with the Service) promoting their goods and services. We use your personal information, such as information about your activities and interests, as well as information about your pets, to show you the advertisements that are most relevant to you.

 

We may show ads that we believe are relevant and useful by making a commitment not to disclose your identity to advertisers. We do not sell your personal information. We allow advertisers to inform us of their business objectives and target audience, which they want to advertise. Then we show their ads to users of the Service who may be interested in it.

 

We may also provide advertisers with ad performance reports that help them understand how users of the Service interact with their content. For example, we provide advertisers with general demographic and interest information so that they get a clearer picture of their audience. We do not provide personally identifiable information to anyone (such as your name and email address, which by themselves can be used to contact you or to identify you) unless you give us permission to do so.

 

Data use policy

 

To provide the Service, we need to collect and use your information. The following describes how we collect and use the information received from you for the purposes of the Service. By agreeing to these Terms of Use, you confirm your agreement with the Service's Data Use Policy.

 

• The Service collects content, data, messages and other information that you provide when using the Service. This includes when you sign up for an account, create or share content, send messages, or interact with other people. This can be information from or about content you provide (such as metadata), such as where the photo was taken, or the date the file was created. In addition, we may collect data about what you see using the features we provide, for example, to suggest masks and filters that you might like, or to give advice on using camera formats. The service processes content, data, messages and other information manually or automatically in order to analyze their context and content for the purposes described below.

• The Service collects uploaded information about users and pets, as well as the interactions between all of them.

• The Service collects information about how you use the Service, such as the types of content you view or interact with; the tools you use; the actions you take; people, pets, or accounts you interact with; the time, frequency and duration of your actions.

• If you make purchases within the Service or through the Service or other financial transactions (including when you make a donation), The Service collects information about the purchase or transaction. This includes billing information such as credit or debit card number and other information about it, billing and shipping, and contact information.

• The Service receives and analyzes content, messages and information that other people provide through their direct or indirect use of the Service. For example, there can be reviews about the work of the Service, as well as when other people comment on your photos, send you a message, upload, sync or import your contact information.

• The service collects information from the devices you use (computers, phones, etc.), as well as information about these devices. For example, the Service uses the information collected about how you use the Service on your phone to more effectively personalize content (including advertising) or features that you see when using the Service on another device.

• The service receives the following information from devices: operating system, hardware and software versions, battery charge level, mobile signal strength, available memory, device identifiers, MAC addresses of devices and its analogues, the name of your mobile operator or provider, language, hour belt, mobile phone number, IP address, type of internet connection, connection speed, browser type, data from cookies. The Service also uses information that you allow to receive by enabling settings for your application in the device (for example, access to data about your location (GPS), camera, photo and video archive, etc.).

• Advertisers and other partners can send information to the Service using the tools they use. These partners provide information about your activities, including information about your device, the sites you visit, the purchases you make, the advertisements you view, and your use of their services. For example, advertisers may tell us your age, gender, perceived personal preferences, or information about purchases you have made in their store. The Service may also receive information about your activities and purchases on and off the Internet from third-party data providers who have the right to provide us with your information. Affiliates receive your data when you visit or use their services, or through third parties with whom they work. We expect each of these partners to have the legal rights to collect, use and transfer your data before providing any data about you to us.

 

Your commitments

 

By using the Service, you confirm that you agree and comply with the obligations and requirements of the Service, as well as other competent organizations and supervisory services, such as, for example, the police or state control services.

 

We want our Service to be as safe, secure and compliant as possible. For this reason, you agree to abide by the following rules:

 

• You must be at least 13 years old or have reached the minimum age from which the Service is legally permitted in your country.

• Your account must not have been previously disabled by us for violating the law or any of our policies.

• You should not be prohibited from receiving any of the components of our Service in accordance with applicable law or from using the Services related to payments if you are on the current banned lists.

• You should not be convicted of a sex offense.

 

You agree not to use the Service in any of the following ways:

 

• You may not impersonate other people or provide inaccurate information that could identify you as any other person.

• You do not have the right to impersonate employees of companies, associations, clubs, projects and other organizations and groups of individuals in which you do not work or do not belong.

• You may not make unlawful, misleading, or deceptive acts or other acts of illegal or unauthorized purposes.

• You agree not to violate (and also not to help others or urge them to violate) any rules available in the Service.

• You have no right to interfere with the normal operation of the Service or interfere with its work in order to cause negative consequences..

• You agree not to attempt to create accounts in unauthorized ways. You agree not to use accounts that do not belong to you or are registered in the names of others. You also agree not to attempt to take over such accounts, including purchase, exchange, inheritance, and so on. You also agree not to transfer your accounts in any way to others.

• You agree not to collect information from the Service by automated means without our express permission.

• You do not have the right, without permission, to publish personal or confidential information of users without explicit permission or otherwise violate anyone's rights, including intellectual property rights (for example, by violating copyright, trademark rights, distributing counterfeit or pirated goods).

• You represent that you own the content that you post or share, or that you have acquired all necessary rights to it.

• You may not copy, modify, create duplicates, rework any parts of the Service or their components, or attempt to create derivative works based on them.

• You may not use the Service name or URL related to the Service in your username without the express permission of the Service. You do not have the right to represent yourself as an employee of the Service and in any way act on behalf of the Service without the explicit permission of the Service.

 

As part of our agreement, you also grant the Service the permissions necessary for its operations:

 

• We do not claim ownership of your content, but you give us a license to use it.

• Your rights to your content remain unaffected. We do not claim ownership of your content that you post to or through the Service, and you may share it with anyone at any time. However, we need to obtain certain legal permissions from you (called a "license") in order to provide the Service. When you post or upload content that is subject to intellectual property rights (such as photos or videos) into our Service, or share such content in or in connection with our Service, you hereby grant us a non-exclusive, royalty-free, worldwide license transferring and sublicensing the storage, use, distribution, modification, launch, copying, public performance or display, translation of your content and the creation of derivative works based on it (in accordance with your privacy and application settings). The license expires when your content is removed from our systems plus five years from that date. You can delete content individually or all at once.

• Permission to use your username, profile photo and information about your connections and activities on the Service related to accounts, advertising and sponsored content.

• You give us permission to display your username, profile photo, and information about your actions (for example, Likes), your connections (for example, subscription and following other users' accounts) and actions with accounts, advertisements, Service offers or sponsored content without paying you any kind of remuneration.

• You agree that we can download and install updates of the Service on your device.

 

Additional rights that we reserve

 

• We reserve the right to change your account name (first name, last name, username, other types of your names and identifiers) if we deem it appropriate or necessary (for example, if it infringes someone's intellectual property rights or if you impersonate another user).

• If you use content that is subject to intellectual property rights held by us and provided by us on our Service, we reserve all rights to our content (but not your content).

 

Removal of content and termination of the provision of the Service

 

• We may remove any content or information that you share on the Service if we believe it violates these Terms of Use or our policies, or if permitted or required by law. We may refuse or immediately stop providing you with the Service in whole or in part in order to protect our community or services, or if you create a risk or adverse legal consequences for us, violate these terms of use or our rules, violate the intellectual property rights of others, or this is permitted or required by law. We also have the right to terminate or modify the operation of the Service, remove or block the content or information provided on our Service, or terminate the provision of the Service in whole or in part, if we believe that this is reasonably necessary to prevent or mitigate negative legal or regulatory consequences for us.

 

Also important terms of the agreement

 

• If any aspect of this agreement is invalid for any reason, the remaining aspects will remain in effect.

• Any amendments or waivers to our agreement must be made with the agreement of the parties.

• We reserve all rights not expressly granted to you.

• This agreement does not give any rights to third parties.

• You are prohibited from transferring your rights or obligations under this agreement without the consent of the Service.

• The Service has the right to assign our rights and obligations to other persons and organizations. For example, this can happen in the event of a change of ownership (in a merger, acquisition or sale of assets) or by virtue of law.

• The Service is provided "as is" and we cannot guarantee that it will be safe, secure, or function perfectly. To the extent permitted by law, we also disclaim all express and implied warranties, including implied warranties of fitness for a purpose, which usually use such products or fitness for a particular purpose, are inalienable title and non-infringement on intellectual property.

• The Service also does not control the statements and actions of people and others and is not responsible for their (or your) actions and behavior (on the Internet and outside it) or content (including illegal or objectionable). In addition, the Service is not responsible for the services and features offered by other people or companies, even if you access them through the Service.

• Our responsibility for everything that happens in the Service (also called "liability") is limited to the maximum extent permitted by law. You agree that we will not be liable for any lost profits or income, lost information or data, or for indirect, punitive or incidental damages arising out of or in connection with these Terms, even if we were aware of the possibility of them arising. This also applies to our removal of your content, information or account.

• If you are a user, any claims, claims and disputes between you and the Service arising out of or in connection with these Terms and Conditions ("dispute") shall be governed by the laws of your country of residence and you may resolve the dispute in any competent court of that country, which he is judged. In all other cases, you agree that the claim must be resolved exclusively in a court located in the country where the Service is located. The Service may, at its discretion, present you with a claim related to an attempt to misuse our products, interfere with their work or interact with them in an unauthorized way, and submit it to a court in the territory of the country where the Service is located or the country of your residence, the jurisdiction of which applies to such claims.

• Feedback and other recommendations are important to us, but we have the right to use them without any restrictions or obligations to pay you remuneration for them, and we are not obliged to keep them as confidential information.

 

Updating the Terms of Service

 

We may change our Service and policies, and we may need to amend these Terms to accurately reflect our Service and policies. Unless otherwise required by law, we will notify you through the Service about changes to the Terms of Use and give you the opportunity to review such changes. If you continue to use the Service after the changes to the Terms of Use become effective, you will be bound by the updated Terms of Use. If you do not agree with these Terms of Use or any updated version of the Terms of Use, you must stop using the Service.
